    (a)  This clause is to be used in conjunction with FAR Clause 
52.223-3, Hazardous Material Identification and Material Safety 
Data, and DFARS Clause 252.223-7001, Hazard Warning Labels.

    (b)  Material Safety Data Sheet (MSDS), meeting the requirements 
of 29 CFR 1910.1200(g) and the latest version of Federal Standard No. 
313, (and a hazard warning label (HWL), when specified by terms of 
DFARS Clause 252.223-7001) shall be provided to DSCR for any item of 
hazardous material to be furnished under the terms of this Blanket 
Purchase Agreement (BPA).

        (1)  Data shall be submitted in accordance with Federal 
Standard No. 313, whether or not the offeror is the actual manufacturer 
of these items.  Failure to comply with submission of the Material 
Safety Data Sheet will result in the contractor being considered 
ineligible to provide hazardous material under this BPA.

        (2)  The BPA contractor shall submit an MSDS (and HWL, if 
required) for each hazardous item(s) to be supplied under the BPA 
either --

            (i)  with the hazardous material list required by FAR 
Clause 52.223-3, or

           (ii)  prior to shipment of the hazardous item, per 
instructions in paragraph (d)(2) below.

        (3)  Once submitted under the terms of this BPA, the MSDS 
and HWL will be valid for the term of the BPA or one year, whichever 
is sooner, unless the MSDS or HWL does not conform to the requirements 
stated in paragraph (b) above, or there is a change in the composition 
of the item or the requirements of Federal Standard No. 313.  If the 
MSDS or HWL does not conform to the stated requirements, the contractor 
shall submit a corrected MSDS or HWL upon request by DSCR.  If the 
composition of the item or the requirements of Federal Standard 313 
change after submission of the MSDS, the contractor shall submit a new 
MSDS in accordance with paragraph (e) of FAR Clause 52.223-3.

        (4)  The MSDS must cite the Blanket Purchase Agreement 
number (to include call number) and the applicable CAGE code of the 
manufacturer, the part number, and where so identified, the National 
Stock Number (NSN).

    (c)  Notwithstanding paragraph (4) of Federal Standard 313C 
(1 March 1988), the contractor shall submit the MSDS and accompanying 
HWL, if any, to --

           Defense Supply Center Richmond
           ATTN:  DSCR-JJD, Contracting Officer

           Richmond, VA  23297-5864

           Fax No. 804-279-6013

This will satisfy the Federal Standard requirement on the part of 
the contractor.

    (d)  When a Shipping Instruction Sheet (SIS) is issued by DSCR 
for a hazardous item to be delivered under the terms of this BPA --

        (1)  If an MSDS (and HWL, if required) for the item to be 
supplied under this SIS HAS BEEN submitted by the BPA contractor 
under the terms of this BPA in accordance with paragraph (b)(2)(i) 
or (ii) above, the call my be accepted and the item may be shipped.

        (2)  If an MSDS (and HWL, if required) for the item to be 
supplied under this SIS HAS NOT BEEN submitted by the BPA contractor 
under the terms of this BPA in accordance with paragraph (b)(2)(i) 
or (ii) above:

            (i)  Shipment shall not be made until the required 
hazardous documents have been submitted to the Contracting Officer.

           (ii)  Contractor shall provide the MSDS/HWL to the 
Contracting Officer via Fax No. 804-279-6013 or mail.

          (iii)  If an HWL is required and the material is subject 
to labeling requirements of one of the acts at paragraph (b) of 
DFARS Clause 252.223-7001, the contractor shall identify on the HWL 
which act the labeling requirement is under.
