Section 5309.505-4: Obtaining Access to Proprietary Information


(b)(90) NON-GOVERNMENT ADVISORS: If non-government advisors in the performance of advisory and assistance (A&AS) services for the Government require access to proprietary information of other companies, the contracting officer shall ensure that the A&AS contracts contain the appropriate OCI clauses. Also, when non-government advisors will be used in the source selection process, the contracting officer shall ensure compliance with the requirements of AFFARS 5315.305(c)(2). See 5309.507.2(a)(3) and (4) below. The use of non-government advisors and OCI clauses should be addressed in the Source Selection Plan for acquisitions using the FAR 15.300 source selection procedures.

509.506 Procedures

(b)(1)(90) Contracting officers shall include the following information in the written analysis of significant potential OCI in addition to the information required by FAR 9.506(b):
(i) Discussion of all four rules in FAR 9.505, including reason(s) for selecting/not selecting each rule.
(ii) Summary of the benefits and detriments to both the government and prospective contractors.
(iii) Statement that the contracting officer will obtain a copy of the agreement(s) required by FAR 9.505-4(b),
